Started prosecuting a rape trial yesterday morning.  Piece of shit raped his 14 year old step-daughter nearly 2 years ago.  Jury just came back after only 30 minutes of deliberation with a GUILTY on all three counts in the indictment.   Not tooting my own horn, well maybe a little, but the best work was done by the police, ER personnel, and DNA experts at Dept. of Forensic Sciences.  Packaged up very nicely for me to present at trial.  I expect a Life sentence for this shit bag.  Wish I hadn't given up booze!  Perfect afternoon to celebrate!

Male student - "Hey, my dad said he'd rent the stripper poles for my birthday party.  He said we could have the wet t-shirt contest too as long as the girls wear bras."
Female student - "Is he going to be there?"
Male student - "Girls in wet t shirts?  Yeah.  He joked about filming it."
Female student - "Cool.  You're dad's so funny."
Male student - "Yeah.  I told him you'd probably win.  (while staring at her chest) I mean, I don't think anyone coming has better looking ones than you."

Yeah, trials don't take as long as they do on TV normally.  A rape trial like this was basically 5 witnesses.  One neighbor, the victim, the detective, the nurse that took the rape kit evidence, and the DNA person from the lab.  Took me a day and a half to strike the jury, and put on all my evidence.  DNA takes the longest...took me all morning yesterday morning to get that done. 

No, the defense had nothing, and he knew it, but he also had nothing to lose by trying it...the guy's getting life when he gets sentenced.

The guy who works receiving at Kilby is a mofo.  I've seen a few get some good prison action before even getting the prison whites on.

DNA evidence for the conviction of the rape of a 14 yr old? And he only gets life? I guess there is hope that he can be rehabilitated. If not, why keep these guys alive sucking up tax dollars.

Life doesn't actually mean "for life" in most cases.  There's probably a good chance that he'll be paroled, but I highly doubt he'll ever be rehabilitated.

The AL DOC calculates "Life" as 33 years.  The DOC changes their rules as the wind blows, but this is considered a violent felony, and they have a "serve 85%" rule on violent felonies.   In the past, on a charge like this, if he got life, he wouldn't come up for parole the first time for @ 12 years, up to maybe 15 years, then usually denied the first time, especially if the victims show up for parole hearings.  This piece of shit is 53 years old.  Rehabilitated or not, he won't be worth a shit if he lives long enough to get out.

1/3 is a pretty good rule of thumb for how long most prisoners will serve on their sentence.  So on 33 years, that would be 11 years.  But like I said, they have a fairly new 85% rule, and now there's a movement towards sentencing guidelines, which are designed toward keeping violent offenders in longer, but keeping the things like drug possession and DUI from cluttering up the prison system.   In general, they're moving towards longer sentences (not on paper, but how long they actually serve) for violent offenses.
