probably from "a different altercation."

Do you think both were with Smith?

No, unless Eric Smith hit that one student so hard, that it caused a rip in the space time continuum and Eric Smith stepped through it and punched that other student, before the police had arrived.....Crazier things have happened, so it's possible I guess.

I was more asking if it was possible if... now just think about this for a second... Smith hit the first guy and then when the cops arrived and began helping him he hit the 2nd guy.  May not have happened that way but that's what I was asking.  No space time continuum needed there.

Nah, that just seems to be too far fetched.

For AUTailgaitingRules:  I found the perpetrator, that damn Birdman.

Don't know why I took from this statement that he was for sure a frat boy since Harvey said "probably" before his accusation.

By the way, I don't care if you care that I don't like frat boys.  Why I don't like them is real simple and it has nothing to do with being in a fraternity or not being in one.  They show up to the games late in the 2nd quarter and leave in the 3rd quarter leaving a huge section that people outside the stadium would love to pay money for to have a seat.

By the way, that was my weak attempt at humor.  I have no knowledge of said injured, drunk, 22 year old, ex-boyfriend, from the skreets, who may or may not have been effing said ex-girlfriend, who was bitch slapped by said large ass running back.....being a frat boy.

But, word on the skreets is that he is a Alpha Delta Lamma Lamma Ding Dong.

Quote
Police officers witnessed Auburn running back Eric Smith strike Auburn student Decari Jenkins in the back of the head, rendering him unconscious outside of a hotel near campus last week, according to a police document obtained by The Birmingham News on Monday.
The police report says Smith, 19, told officers that Jenkins, 22, had punched him earlier and Smith ``did appear to have blood coming from his nose at the time of the incident.''

Smith surrendered to police Monday afternoon after Jenkins filed a third-degree assault complaint against Smith in connection with the incident at the Lexington Hotel near the Auburn campus after midnight last Thursday. Smith posted bail Monday and was released. He has not been allowed to practice with the football team since the incident.

Police originally charged Smith with disorderly conduct at 1:42 a.m. Friday.

Jenkins was transported by ambulance to the East Alabama Medical Center for treatment. Smith was charged with disorderly conduct and booked at the Lee County Jail. Smith did not resist arrest, according to the police report.

Smith has missed all three practices since the incident, and coach Gene Chizik said Smith will have ``paid a price'' before he will be allowed to wear an Auburn uniform again.

Smith is a backup running back who gained 83 yards last season. He played in all 12 games.

The police report says officers witnessed Smith strike Jenkins, causing Jenkins ``to fall face forward onto the asphalt. Jenkins suffered a cut and severe swelling around his eye and was knocked unconscious.''

Jenkins said in his complaint that he was at a party at the Lexington Hotel and was struck from behind ``and became disoriented.'' He said he went outside and ``was struck again.'' He said he was struck a third time as he moved to his car. Jenkins' complaint does not identify Smith by name.
Looks like the other guy may have started it, but Smith finished it. Which might not have been a problem had Smith not followed the guy outside, struck him multiple times, and caused him to be unconscious. Jesus, why can't we just see a police report? I wonder why the guy hit Smith in the first place.

It's fucked up that the guy can file assault for STARTING a fight with a football player who can clearly kick his ass, just because he lost the fight that HE STARTED.

In a fight, you have the right to reasonably defend yourself to the point that you can safely notify law enforcement. You don't have the right to beat the other party to a pulp, but you would be hard pressed to find an officer that would charge you for doing so as long as it is very clear you didn't start it and did not escalate the situation into a fight. Most officers would see it as it shouldn't be your fault some jackass decided to start shit with you and he caught the bad end of it.

However, even if somebody hits you, and you walk away or the other party walks away, and you find them an hour later and wail on them, you can catch an assault charge. If somebody hits you and walks away or whatever, you call the police and you are exected to handle things through the proper channels. Like I said earlier, I wonder what caused the guy to hit Smith in the first place. People don't normally just randomly walk up to some guy and pop him in the nose without some sort of words or something exchanged beforehand. Unless he's Rick James or some shit.

Nobody can file charges on his behalf if he is over the age of 18, except the State of Alabama.

I'm with you rws, where's the fuckin' police report?  I see where the guy stated that he was struck twice outside of the bar as he was making his way to his car.  But, I also see where the Police state, in their report, that Mr. Smith donkey punched the guy...ONCE...and he landed on the asphalt with his face....causing swelling, a cut and was knocked unconscious.  Which is it?  Did Eric punch him multiple times, as the guy states, or did Eric punch him once in the back of the head?

According to the guy, Eric Smith hit him three times, and the third time knocked him out. Supposedly Smith was hit once. At least thats what I read, anyway.

Here's how it went down.....I think I can piece it together, then after this all of the stories should make a little more sense.  Eric Smith was at a Hotel Bar with some friends, when in walks his ex-girlfriend and her new boyfriend, Decari Jenkins.  Eric wasn't too happy about that, so he had some words with Decari.  Decari then punched Eric....I'm guessing in the face, or possibly the taint, who knows.  Then Eric punched Decari in the face (Punch #1 by Eric).  That's when his ex-girlfriend poured beer on him.  Then Decari said that they should take this shit outside.  As they stepped out of the door, Eric donkey punched him in the back of the head (Punch #2 by Eric), causing Decari's face to soften the blow as he landed on the soft asphalt....which knocked him out and busted open his face (Punch #3 by the asphalt).

Sounds like Eric Smith instigated the fight, and finished it.

I went to high school with two Eric Smiths.  They were both incredibly athletic.  One excelled at fullback for our football team, and the other was a smooth power forward for the roundball squad.  They would both beat your ass in a heartbeat.

This is obviously just what Eric Smiths do in life, people.

wrong again, bitch.  I've only offered TWO versions of the events, the last post was to piece everything together for it to make a little more sense.  Go ahead and put stock in whatever the fuck you want to, no one is making you believe anything you hear and you certainly don't have to read any posts that you don't agree with.  So, just keep walkin' bitch.
