i don't really see how this would impact Alabama sanctions wise. i believe contact is permissable, you or somebody acting on your behalf just can't receive any kind of favors or anything even in the realm of being considered compensatory from an agent. either way, it would all depend on whether or not the university knew about it or not. it wouldn't make any sense that he had been getting something say all season for them to know about it and get all this way and all of the sudden suspend him for the Sugar Bowl. if they knew, would 1 more game really matter in the grand scheme of future sanctions? i know you guys want horribly for forfeitures so you can claim #7 (which is sort of sad seeing as how we still rocked your asses on the field) and sanctions so you can see us go down the tubes again, but i really don't see it happening. i think you guys know that as well, but i guess it is fun wishing for our demise while your program is in the shitter.
If you played the game with an ineligible player, that makes you a cheater

according to a new story on BOL, there were actually two agents involved. apparently a family member of Smith's family had been acting on his behalf with two agents. when it was decided which agent would be used, they notified the one who would not be getting his business. apparently he didn't take the news too well and leaked info to the university of Smith's dealings with the other agent, and thats how we got where we are now. it would have been nice for that agent to try and do the right thing before he wasn't going to get what he wanted, but oh well.

i really don't see the NCAA coming down on us for something that was going in within his family and that they were keeping hush. if he was suspended as soon as the information was brought to the university's attention, i really don't see them penalizing the university for something he and his family were doing and worked to keep a secret unknown to the university. again, i know you really really want them to because it will make you feel better, but i really don't see it happening. some of you swore we would have to forfeit games that Josh Chapman played in or that the NCAA would come down on us like a rat on a Cheet-O, but they didn't because they said he didn't know people were doing things for him and Alabama had no hand in making it happen either. same deal here. as long as we didn't know about it going on, they're not going to do anything.

Well then.  I think we can close the book on the Andre Smith thing then.  runswithanallubeonchin has made his opinion known.  Nothing to see here.

Of COURSE you don't think there's much going on, because you certainly will NOT hear all the facts from ANY radio out of B'ham, not on Finebaum.... and CERTAINLY not from Bammer internets....

I don't think we know HALF of what's happening.  This is already MUCH bigger than the Chapman story, and I've NEVER heard the radio heads work so fucking hard at painting Andre as a church choir boy...  pooooor poooor Andre.  He didn't turn his phone records over...what's up with that?????  haha...   He's TOTALLY innocent though...

Fuck that..  We'll just have to wait and see what the AG and others come up with.  I don't think this is over for a long shot.

I love how they keep playing the clip from F'bomb saying that he even thinks that Andre might have even been the one to go to the university to let them know what he knew, yet in the same clip acknowledges that Andre refused to turn over records and other information requested from him.   Fuck, they can't even keep their spin straight now...  This is an all out media blanket trying to smother a fire...  Laughable....

i never said he was innocent. i said that maybe he didn't realize something he was doing was wrong, but that i also believed that probably wasn't the case and that he knows the rules of the game. i have no doubt at this point that he knew what was going on. my point is simply that if the university did not know about it, i don't see how the NCAA would penalize them. now if a booster or something was the one arranging all the agent stuff, then we would be in some deep shit. but it was somebody in his family that was acting as Smith's "handler". he knew what was up. Andre knew what was up. the university didn't, and i think thats what will make all the difference in the world. also, i wasn't aware that the NCAA or the AG has already requested his phone records 2 days into this.....where did you see that his records have been requested? they sure do act quick nowadays, huh? again, i don't think it will matter when this took place. from what it looks like, it was very recent anyway. what will matter imo is when the university knew about it and when they acted. i don't think the NCAA generally penalizes schools for something players and their families do independently of the university without anybody's knowledge of it.

Chris Low reported on F'bombs show yesterday afternoon that Andre met with University officials before he was sent home and at THAT time, was asked to provide them with his phone records.  He refused.  He was sent home shortly after.  The NCAA might not be able to do anything, but Andre is getting painted to be a church choir innoncent child here by F'bomb and The Roundtable on JOX, and THAT is what is getting ridiculous.  Also, even if the NCAA doesn't do anything, if the University finds out that this happened back during the early season with this Melvin character that's now involved (a guy thats been investigated for paying players and is on the NFL watch list of troublemakers), Bama would STILL have to forfeit the ballgames he played in after the improper contact occurred.

It's nowhere CLOSE to over.  F'bomb is too ate up with is "Caller of the Year" deal to even be covering it.  This is laughable.  He doesn't even want to talk about it.  There is NOTHING good for anyone involved with this.

i just really don't see the NCAA sanctioning Alabama for something it knew NOTHING about. what decides that is not so much when whatever impropriety took place, its more so when the university found out and what it did about it. how is the NCAA going to punish Alabama for something that was not done by the university or somebody acting on its behalf or in its interest, but was done on the sly by Andre and a family member? that makes absolutely no sense. i doubt this thing even went past the SECCG anyway, if not between now and then. where USC got their asses in a crack was that they were letting the agents from New Era into the locker room to do business with Bush, letting them watch games on the sidelines, etc etc. they knew what was up and didn't do shit. while Andre stayed out of trouble while at Alabama, he really screwed the pooch with this. he knew what was up and if in fact the university did request his phone records and he refused, it screams that he did.

EDIT: CNS just spoke regarding Andre and he says that Alabama has verified with the NCAA that this will be an institutional matter to resolve and not an NCAA matter, otherwise meaning there will be no NCAA fallout from it. he also says that Smith could come back next season if he wishes according to the NCAA. so, if the NCAA sees no reason to get involved in it, then i wonder what the fuck actually happened.

The NCAA doesn't work that fast, I'm not saying that it won't be an institutional matter...eventually, but the uat officials found out about what had happened, had a meeting with Andre and I'm guessing $aban, they felt that it was best for the University to Not let Andre play in the Sugar Bowl, supposedly after Andre wouldn't let the University have his cellphone records...this happened on Saturday or Sunday...Yesterday (Tuesday) it was stated that the AG dept. and Troy King is stepping in to "Investigate" the matter.  So, the NCAA, I'm guess with the help of Gene Marsh, has decided to state...."Nothing to see here, everything is hunky dory."  It's funny that McClain stated, in the B'Ham News today, something about this being handled as a "family matter"...is he saying that it'll be handled "In House", and if so, how would he know that in the matter of two days?

The agent...or now, agents will probably be taken to court, because in the State of Alabama, the maximum sentence for illegal contact made by an agent to a Student-Athlete and/or family member(s) is up to 20 Years.  Also, the Cell Phone records might be incriminating.  We should know more by Monday or Tuesday...that is if you can wade through all the bammer homerism.

IMO, with uat Not being USC or the Bell Cow of a conference, if Andre made contact with the agent or agents before the season started or sometime during the season, he would be considered ineligible and uat would have to forfeit ALL games he played in.  I'm not sure forfeiture would occur if it was just someone close to Andre that made the contact, unless Andre knew about it....basically okaying it...which would be the same as him making the contact with the agent or agents.  If uat knew about it, depending on when it happened, and let it go, that would bring the LOIC tag to be placed on the uat program with the addition of Repeat Offender.  uat would be looking down the "Loaded Barrel" with a Bullseye between their eyes.

No one Really knows what happened except for a handful of bammers......but, everyone should know what'll happen.
