Gene Chizik's new contract still holds him accountable for NCAA compliance

By Kevin Scarbinsky, Birmingham News al.com

Gene Chizik still has to answer for the way he runs his Auburn football program. (The Birmingham News/Hal Yeager)

BIRMINGHAM, Alabama - It's hard to keep up with all the allegations, suppositions, suggestions, charges, half-truths and facts without context that continue to be lobbed like grenades at the Auburn football program.

They've piled up almost as high as all those championship rings and trophies down on the Plain.

Auburn officials have been wise not to reply to every post, blog and tweet designed to sully their name because a) some of those ramblings don't deserve the dignity of a reply, and b) there's not enough time in the day.

In the interest of fairness, one failed attempt to connect the dots should be addressed because its premise is blatantly false.

Stop me if you've heard this one: Gene Chizik's new contract is a shameless attempt to absolve him of responsibility for impeachable offenses under NCAA law.

That would be shocking and shameless and headline news, if it were true.

It's not.

The web site SportsbyBrooks.com tried to make that case, one of its many against the Tigers, with a post titled, "Auburn Openly Mocks NCAA President - In Writing." The premise is that Mark Emmert wants to increase the risk for coaches who break the rules but that Auburn has decreased the risk for Chizik to cheat by taking out the original Paragraph 13 (d) from his new contract.

That paragraph gave Auburn the right to suspend all but the $500,000 base salary of Chizik's pay during an internal, SEC or NCAA investigation. If Auburn invoked that right, and no major violations were found, Chizik would be paid in full what he was owed, plus interest.

For the record, sources close to Auburn and Chizik confirmed that the school has not withheld any money from its head coach despite an NCAA probe into Cam Newton's recruiting.

So why did Auburn remove 13 (d) from Chizik's new contract and replace it with more generic language that binds him to "comply with the enforcement, penalty and other disciplinary provisions and procedures of the NCAA and the SEC"?

Part of the reason has to do with keeping the contracts of Chizik and basketball coach Tony Barbee on a level playing field on that subject. Barbee and his reps objected to the language in 13 (d) in Barbee's contract, and an Auburn official told me in November that the school agreed to remove that language.

Still, despite assurances for weeks that its completion was imminent, Barbee's contract remains unsigned 15 months after he was hired.

As for Chizik, the original Paragraph 13 (d) in his first contract was overkill when you read the very next paragraph, 13 (e), which remains unchanged in his new deal.

Paragraph 13 (e) says, "Pursuant to NCAA Bylaw 11.2.1, it is agreed that Coach may be suspended for a period of time without pay, or his employment may be terminated, if University, the SEC or the NCAA concludes or has reasonable basis to believe, after providing Coach notice (including being made aware of the allegations at issue) and an opportunity to be heard, that he or any person under his supervision or subject to his control or authority is involved in significant or repetitive violations of NCAA regulations."

That's how you reinforce the importance of playing by the rules.

While Auburn no longer can suspend a large chunk of Chizik's pay during an investigation, the school still can suspend him without pay or fire him if he or anyone on his staff gets busted. That's hardly "Auburn bankrupting Chizik's contractual obligation to NCAA rules," as SportsbyBrooks wrote.

The new contract, minus the old Paragraph 13 (d), simply means that Auburn no longer has the right to presume that Chizik is guilty until proven innocent and to penalize him before the facts are in and a conclusion is drawn from those facts.

That's only fair and besides, there are plenty of people, in the blogosphere and beyond, who've made that presumption already.

If they're right, and Chizik and/or his staff have done wrong in a major way, he'll be gone, and there's nothing in his new contract that can save him.

At least the coaches are accountable - in writing.

What about their accusers?

"Hey my friends are the ones that wanted to eat at that shitty hole in the wall that only served bread and wine.  What kind of brick and mud business model is that.  Stick to the cart if that's all you're going to serve.  Then that dude came in with like 12 other people, and some of them weren't even wearing shoes, and the restaurant sat them right across from us. It was gross, and they were all stinky and dirty.  Then dude starts talking about eating his body and drinking his blood...I almost lost it.  That's the last supper I'll ever have there, and I hope he dies a horrible death."

Don't forget, that despite what the truth is, a truth can be manufactured by simply repeating a non-truth as if it's a truth, over and over and over.

The one thing about SportsbyBrooks is that all the publicity that he gets is good for him.  So he doesn't really care what he writes or what people say.  What people forget in this day and age of the internet is that he is selling a product on his website. So the more outrageous posts he has and comments he gets on them draws traffic to his website.

Which in turn, ups his google rank, which = money.  Either through AD's or affiliate programs.  I GUARANTEE you all this is about is money in his pocket.  Just remember everyone gets mad at him writing these ridiculous stories, and he is laughing all the way to the bank.

Agree with that as well. I've been harking since December that this will keep happening until someone sues the shit out of someone for defamation. I hope it happens. And this is coming from someone who hates you lawyers.  :poke:

Brooks left his piece to innuendo, but yesterday on Finebaum, it ceased being innuendo, and was a full blown allegation that the Tigerettes are an on campus, state funded call girl service for recruits.  Finebaum not only provided the forum for his idiot callers, he participated as well.
