AUBURN, Ala. --- The second lawyer appointed to represent the man charged with poisoning two oaks at Toomer's Corner at Auburn University has asked to be let off the case.

Jerry Hauser filed the withdrawal motion Tuesday morning.

Hauser is representing Harvey Updyke who is charged last week with criminal mischief for the poisoning of the two iconic trees.

Hauser claimed in his request that he has a conflict of interest in the case because his wife is the Head of the Department of Communication and Journalism at Auburn University.

Updyke's first attorney, Phillip Tyler, filed a similar request the day he was appointed, which was granted.

They are just going to have to apoint an out of town atty is all.  No atty in Lee Co is going to touch it.

All at taxpayer expense, of course, what with him being destitute and all...

I am surprised some big name bammer grad attorney has not offered to defend him pro bono in hopes of getting those big unmarked envelopes full of non-sequential bills slipped under his door.  If his clients are all bammer fans anyway, then he should not suffer any drop off in his practice, right?

Absolutely no way a Lee Co attorney or a non-bammer grad can touch this.

Theres not anything much in it to take it pro bono.  Few attorneys ever do that.  Folks don't routinely pay their own legal bills, let alone those of another.  Despite what you hear from bammers, only to a select few is Updyke any kind of hero, and those that think he is are poor white trash.  Appointed legal defense isnt a huge taxpayer burden.  Court fees and such cover most, and if he pleads guilty he can be ordered to pay his appointed attorney fees.

Theyll find a Montgomery atty to take it, or the judge will order some poor soul to do it with the promise of many more casez appointed as a thanks.

Updyke is free on $50,000 bond.

His second attorney, Jerry W. Hauser, filed a motion Tuesday morning to withdraw as Updyke's court-appointed attorney, citing a conflict of interest. His wife, Dr. Margaret E. Fitch-Hauser, is the head of the Department of Communications and Journalism at Auburn.

Updyke's first court-appointed attorney, Philip Tyler, was removed after he filed a motion to withdraw, also citing a conflict of interest.

My guess would be Mont. Autauga and Elmore, but Ive never heard that reference at all.
I've heard Elmore, Montgomery, and Autauga County referred to as the tri-county area since I was born.

Thomas Goode Jones Law School was good enough to get me thru the bar the first try.  It was a night school up to about 2002.
