Faulkner Football Player Shot and Killed

Montgomery police have charged three Faulkner University students in the Wednesday night shooting death of football player Ryan Brooks.

Police say Brooks, 19, of Chelsea was shot by a homeowner in the 5900 block of Woodmere Boulevard when he and three other students attempted to break into a residence to commit a robbery.

The homeowner shot Brooks in self-defense, according to police.

Montgomery police say those Faulkner University students involved in the home invasion robbery have been charged with murder.

They are: Marshall Wall, 19, Ronnie Williams 19, both of Loxley, and Tabias Russell, 19, of Alexander City. They are being held in the Montgomery County Detention Facility on $75,000 bond.

Appealing to the lawyers among us here, please explain this to me. They didn't shoot him but they are charged with murder. Is it because they were there when he got shot?

Yeah I'm not understanding that one either.  How did they commit murder?

al.com strangely released a story about how great of a guy he was.

http://www.al.com/news/birmingham/index.ssf/2014/12/slain_faulkner_university_foot.html#incart_2box

Seems especially odd in light of the Ferguson situation where Mike Brown was seen by many as a thug (he was) who attacked a police officer (he did) and was killed for it.  If the mainstream media were using the same logic in this story as they did with Brown, they would be screaming for the homeowner to be arrested and charged with something.  Because as al.com portrayed, he's a good kid and made one silly mistake and is dead now because a homeowner had a gun and shot him.

In the state of Alabama, the common law felony murder rule has been codified in Alabama Code § 13A-6-2(a)(3). It provides that when a person commits various crimes and "in the course of and in furtherance of the crime" another is killed, then the perpetrator is guilty of murder, a "Class A Felony", the punishment of which is death or life imprisonment.

It is pretty common.

Felony Murder Rule

Most forms of murder require an intent to commit death. Felony murder only requires the intent to commit the felony. During the course of the felony, any homicide will be considered murder, whether it's intentional or accidental. This is called the felony murder rule.

Under the felony murder rule, all participants of a felony can be charged with murder if a homicide occurs. This is true even if a participant isn't directly responsible for the death. For example, the driver of a getaway car can be charged with felony murder if his partner accidentally shoots someone while attempting to rob a bank. The purpose for the felony murder rule is to deter people from engaging in felonies knowing that they can be liable for the actions of their partners.

I have heard that it is not prosecutable after the first rain.

"Hey my friends are the ones that wanted to eat at that shitty hole in the wall that only served bread and wine.  What kind of brick and mud business model is that.  Stick to the cart if that's all you're going to serve.  Then that dude came in with like 12 other people, and some of them weren't even wearing shoes, and the restaurant sat them right across from us. It was gross, and they were all stinky and dirty.  Then dude starts talking about eating his body and drinking his blood...I almost lost it.  That's the last supper I'll ever have there, and I hope he dies a horrible death."
