A Los Angeles man has filed a lawsuit against Krispy Kreme Doughnuts, alleging that the pastry chain falsely advertises the ingredients of its fruit-filled and maple-glazed donuts.
The suit, filed Wednesday in a U.S. District Court for the Central District of California by Jason Saidian, is seeking class action status for Krispy Kreme customers. The plaintiff is asking for more than $5 million in
damages 
from the North Carolina-based chain due to the alleged nonexistence of the “premium ingredients†advertised, Top Class Actions reports.
In the complaint, Saidian claims that the doughnut maker conducts “false and misleading business practices†because its “Chocolate Iced Raspberry Filled,†“Glazed Raspberry Filled,†“Maple Bar,†and “Glazed Blueberry Cake†doughnuts and holes don’t actually contain real raspberries, maple or blueberries.
Instead, the complaint alleges, the donuts are made with “nutritionally inferior ingredients.†As one example, on its website, Krispy Kreme lists the ingredients for its "Blueberry Sugar Bits" as consisting of sugar, corn syrup, palm oil, and a variety of artificial flavors and colorants-- but no fruit.
Saidian, however, says that the chain advertises its products as containing “premium ingredients†but Krispy Kreme isn't forthcoming on what specific ingredients are actually in all of its treats.He also says he wouldn’t have purchased certain Krispy Kreme donuts-- namely those being advertised as containing fruit or maple-- if he had been aware of what they actually contain.
“Unbeknownst to Plaintiff and other consumers, the Raspberry Products do not contain actual raspberries, the Maple Products do not contain actual maple syrup or maple sugar and the Blueberry Products do not contain actual blueberries,†the lawsuit reads.
Saidian's lawsuit claims he feels cheated because the company has used real fruit ingredients in other items such as the Glazed Lemon Filled and Glazed Strawberry Filled doughnuts.
A representative for the doughnut chain, which was founded in 1937, stated that the company does not comment on ongoing or pending litigation.
