Capps, deputies said, came out of the bar and confronted the club owner, demanding to know why he was near his car. The owner told Capps he had called the sheriff's office to report the child left unattended.

By the time deputies arrived, Capps had taken his brother out of the car and was walking in the middle of Warrior-Jasper Road toward Bankhead Highway.

The child was released to the custody of his sister. The Department of Human Resources was notified.
