Former Auburn player Mike McNeil was twice evicted, facing lawsuit when alleged armed robbery took place

AUBURN, Alabama -- Former Auburn football player Mike McNeil was facing a lawsuit for thousands of dollars and had just been evicted from a second apartment when police and prosecutors allege he was one of 4 people who robbed the residents of an off-campus trailer home 2 months ago.

McNeil, along with Antonio Goodwin, Shaun Kitchens and Dakota Mosley, were immediately dismissed from the team after being arrested for the armed robbery in the early morning hours of March 11. The 4 ex-players are scheduled to be arraigned Thursday.

A review of Alabama court documents involving McNeil reveals no criminal record beyond a speeding ticket. But McNeil and another player, former Auburn defensive tackle Mike Blanc, were being sued by a former landlord in state court.

Records also show that McNeil and Blanc as well as current Auburn defensive back Neiko Thorpe were evicted from a different apartment on March 4, just a week before the alleged robbery.

Blanc and McNeil served with eviction papers from first landlord

Blanc and McNeil were served with eviction papers from their first landlord, Liberty Properties, in April 2010. Liberty subsequently sued Blanc and McNeil for unpaid rent, according to court records.

As that case wound its way through the judicial system, McNeil and Blanc were running into difficulties at their new apartment complex, an upscale townhouse community called Copper Beech that is made up primarily of Auburn students.

Copper Beech filed an unlawful detainer complaint -- a legal term for eviction -- and court records indicate that Thorpe was personally served by a Lee County Sheriff's deputy on March 4.

A week later, McNeil and three teammates were arrested on the armed robbery charges.

On March 27, only 12 days after McNeil was released on bond, a judge issued a summary judgment against Blanc and McNeil in the Liberty Property case. A summary judgment indicates that the defendants failed to answer the charges and so the judge rules in favor of the plaintiff.

The bill was $12,385, including about $3,000 in attorney fees and $500 in filing fees.

David Whatley, the attorney for Liberty Properties, did not immediately return a call for comment. Copper Beech also declined to comment.

Attempts to reach Blanc and McNeil for comment were unsuccessful. An Auburn spokesperson said Thorpe would not be available to speak about the matter.

Blanc and Thorpe are not accused of wrongdoing in the robbery case.

Thorpe and 3 other current players -- running backs Mike Dyer and Anthony Morgan and receiver DeAngelo Benton -- are listed as possible witnesses in the case.

The 4 former players were indicted on 5 counts of first-degree robbery, 1 count of first-degree burglary and 1 count of third-degree theft of property. Mosley also faces an additional misdemeanor count of conspiracy to hinder business.

The accused former players appeared in court last month for a preliminary hearing that was closed to the public because 3 of the 4 (all but McNeil) are eligible to apply for youthful offender status.

The three younger defendants could apply for that status at their arraignment. Probation officers would review the application and a judge would rule after input or objections from prosecutors.

Youthful offender status, if granted, would seal case records and give defendants a chance to avoid jail time if certain conditions are met.

Yes...Mr. Positive writes another masterpiece.

One random thing came to mind while reading that.  Certainly, there's been a lot of fine investigative reporting that virtually every media outlet has been doing on Auburn in the past 6-7 months.  The latest being the HBO documentary on players gettin' $$$.  So you've got at least 3 of your starters getting evicted and sued because they can't/won't pay the rent....however....

My doctor told me I needed to stop masturbating.  I asked him why, and he said, "because I'm trying to examine you."
