A dad here in Houston was acquitted of murder recently. He and the family were driving home when the car broke down. His 11 and 12 year old sons got out to help him push the car the last little bit to their house which was not too far down the road on the other side of some woods. A drunk driver rear ended them, killing both boys, one of whom was cut completely in two at the waist.
By the time the police arrived, the drunk driver had been shot and killed. The dad claimed he was innocent, and gunshot residue tests on his hands were negative. Never found the murder weapon. Dad alleged some other dude did it. Witnesses in the car (also drunk) claim the dad did it - ran home, got a gun, ran back and shot the drunk guy in cold blood.
Drunk driver was a serial DUI offender as well.
Dad was arrested and charged with murder. Prosecution had purely circumstantial case since no gun was found and the GSR test was negative. Jury took no time at all to acquit, citing major reasonable doubt.

Honestly, I find the story suspect. I mean the guy ran home to get his gun....

Investigators testified that a bullet fragment found in Banda's car could have come from a .357-caliber gun, and that ammunition for such a gun was found in Barajas' home, along with a holster. Cammack said his client never owned a gun and that tests showed the bullet fragment also could have come from another weapon.

I'm sure the dad would have preferred that the drunk hit a tree and kill himself.
Either way, justice is served.
And those around him helped serve it.

He is Hispanic.
I came home from work and the wify had Dr. Phil on. This was the wxact story he was covering. Had the dad and mother on interviewing them. Showed the dash-cam videos, and went in to theories as to what the father thinks happened.

I would of found the guy not guilty of any charges even if he had confessed to shooting him.

It certainly seemed simpler in this case to go with the "nuh uh" defense rather than the temporary insanity plea but it would've been damn hard for me to true bill him as a member of a grand jury. Wonder if he winked every time he denied it.

Folks say "got away with murder", but I'm sure that fella doesn't feel he "got away" with much of anything.
