A Florida judge who told a public defender Monday “I’ll just beat your ass,” before allegedly doing just that, is now the subject of a criminal investigation as he takes time off work for anger management treatment.

Brevard County Judge John Murphy was displeased that public defender Andrew Weinstock would not waive a client’s Sixth Amendment right to a speedy trial in a misdemeanor case.

"You know, if I had a rock I would throw it at you right now – stop pissing me off, just sit down, I’ll take care of it," Murphy said to Weinstock, according to video footage aired by WFTV.

“You know I'm the public defender,” Weinstock countered. “I have a right to be here and I have a right to stand and represent my clients.”

Weinstock’s pluck launched Murphy into a blind rage. "If you want to fight, let's go out back and I'll just beat your ass," he said.

Murphy isn’t seen leaving the courtroom in the video, but reportedly did so first, followed by Weinstock.

Loud smacking noises are then heard as a man shrieks: “You want to f-ck with me? Do you?” Shocked court-goers gasp, and one person whispers to another “get some help.”

The public defender says he expected a conversation outside the courtroom, but was instead ambushed by a fist-flinging Murphy, who was re-elected in 2012 to a second six-year term.

Police are investigating the incident.

“It’s still an ongoing investigation,” Brevard County Sheriff’s Office spokesperson Maria Fernez tells U.S. News.

Sheriff’s deputies have interviewed several witnesses, Fernez says, and will interview others. A final report has not been submitted by investigators.

Weinstock’s boss Blaise Trettis says the attorney will not provide a statement to the sheriff’s office, greatly reducing the likelihood of criminal charges against the judge.

“It’s something he would like to get behind him and just does not want to have to deal with on a continuous basis,” Trettis tells U.S. News.

Fernez says it’s common for Florida police to avoid filing charges when the victim of an attack refuses to cooperate.

In a Tuesday afternoon statement Chief Judge John M. Harris of Florida's Eighteenth Judicial Circuit announced Murphy "has agreed to seek anger management counseling and treatment during a temporary leave of absence."

Harris said the incident is not representative of the local justice system.

"People come to court seeking justice and a peaceful resolution to their conflicts and they have the right to expect a much higher standard of behavior from our judges," he said.

Trettis, a Republican elected to lead the Brevard and Seminole County Public Defender’s Office, oversees 60 attorneys handling a combined 28,000 cases a year. He says Murphy is typically levelheaded.

“I was shocked, it was an isolated incident completely uncharacteristic of Judge Murphy, who has an excellent reputation,” he says.

Trettis says he doesn’t believe Weinstock did anything wrong.

“I think he was sticking up for his client’s constitutional rights and that is what precipitated this argument,” he says, “I think the judge got angry about that because it was causing, perhaps, scheduling problems."

Trettis added, if Weinstock “could do it all over again, I guess he should not have followed the judge back into the hallway, but [Weinstock] said he had no reason to think – despite what was said – that he was going to be grabbed or punched.”

I'd be pissed too if I was that judge.  The Public Defender obviously didn't care enough about his client's problems.

Yeah...read the article then watched the video and I am calling bullshit. The lawyer didn't walk outside like he was just wanting to talk...and he was instigating the reaction like there is a history with these two...not saying that the judge was right, but the lawyer isn't poor old victim who was just trying to do what's best...

They may have been having rough sex instead of fighting. I read a statistic recently but I can't recall the exact number. But the vast majority of lawyers are queer. Either all or part. But, we knew that.

They may have been having rough sex instead of fighting. I read a statistic recently but I can't recall the exact number. But the vast majority of lawyers are queer. Either all or part. But, we knew that.

Well, this is true. But just to clarify, I didn't intentionally use queer to offend anyone or define lawyers as weird or quirky. I meant it, as in sucks dicks. Faggish type takes it up the ass queers.

This lawyer had just purchased a brand new $125,000.00 Mercedes.  He wanted to make sure everyone saw him so he parked on the busy street in front of his firm.  When he opened the door and started to get out......WHAM...a passing truck took his door off.  The truck quickly left the scene and the lawyer was in the middle of the street pitching one hell of a fit.

"SON OF A BITCH. THAT'S A BRAND NEW MERCEDES.  I CAN'T BELIEVE THAT BASTARD TOOK MY DOOR OFF..."

This man on the sidewalk comes running up to him and says, "Don't worry, I got the tag number.  The police will find him and you can get your car fixed."

DAMN IT, MAN.  YOU DON'T UNDERSTAND.  THAT WAS A $125,000.00 CAR.  I'M A LAWYER.  I KNOW THESE THINGS. IT'LL NEVER BE RIGHT.  EVER.

To which the man replied, "You lawyers are all alike.  All you care about is money and material things.  Do you even know that the truck took your right arm clean off?"

The lawyer stopped his rant and slowly looked down at his bloody shoulder, where his arm used to be.  He began to turn pale and looked to be going in shock when he said...
