You fear for your life in Lee County so you leave the courthouse and go straight to a gas station. Get out of the car and "Black out". Go to the nearest ER while in the meantime, an anonymous caller calls a TV station in Montgomery to say Updick has been stabbed. TV stations reporter just happens to be right there, walks in the ER as Updick is walking in. His attorney is on the phone, not with the police, not with the DA....but with Pawwwl Finebaum claiming his client was "assaulted".
Naaaa....wasn't staged.

(a) A person commits the crime of falsely reporting an incident if with knowledge that the information reported, conveyed, or circulated is false, he or she initiates or circulates a false report or warning of an alleged occurrence or impending occurrence of a fire, bomb, explosion, crime, catastrophe, or emergency or the alleged release or impending release of a hazardous or dangerous substance, including, but not limited to, chemical, biological, or bacteriological substance or any nerve agent under circumstances in which it is likely to cause evacuation of a building, place of assembly, or transportation facility, or to cause public inconvenience or alarm.
(b) Falsely reporting an incident is a Class A misdemeanor except that falsely reporting an incident of a bomb or explosion or the alleged release or impending release of a hazardous or dangerous substance is a Class C felony. Notwithstanding any other provision of law to the contrary, if the objective or target of the person listed in subsection (a) is to interfere with the attendance, operation, activities, or other business conducted at a public or private school, university, college, or other educational institution in this state, no part of a sentence imposed pursuant to subsection (a) or this subsection shall be probated, deferred, suspended, or withheld, and no person sentenced pursuant to subsection (a) or this subsection shall be eligible for early release, leave, work release, earned time, good time, or any other program administered by an agency of the executive or judicial branches of this state which would have the effect of reducing or mitigating the sentence until the defendant has completed the minimum sentence pursuant to subsection (a) or this subsection.

Harvey Updyke's attorney says his client was struck in the head at a gas station in Opelika a short time after leaving a courthouse where he waived his right to a preliminary hearing over the poisoning of the iconic oak trees at Toomer's Corner in Auburn.
Attorney Glennon Threatt told of the incident on the Paul Finebaum radio show.
An employee at the Tiger Express gas station in Opelika said Updyke said he was "jumped behind the store," but the employee didn't know any other details. The employee, who requested not to be identified, said she did not see any police cars or ambulances at the gas station.
Opelika police Capt. Allan Elkins said Updyke suffered a scratch to the forehead during the alleged assault at the Tiger Express, according to the Opelika-Auburn News.
Elkins said Updyke "has not really been too cooperative at this point."
Elkins told the newspaper that Updyke could not identify or describe assailants, and gas station did not have surveillance in parking lot.
Threatt said the incident happened like this:
"Somewhere right outside of Opelika Harvey stopped at a gas station to get a drink and some gas, and when he got out of his car, it went black," Threatt said. "He woke up on the ground. He had been hit in the head with something. He wandered into the gas station in pain, and they directed him to a local emergency room."
Updyke received treatment at the emergency room. He has since talked to the police.
Threatt said Updyke had received facial bruises and a split in his brow
"He's been released from the emergency room, and I'm not a doctor, but when they release you they think it's OK," Threatt said. "It doesn't sound like he required stitches. It doesn't sound like he's got permanent injuries, other than he may have a slight concussion."
The court said Updyke could leave Alabama and to be with his family in Louisiana while awaiting trial. Today's court story is here.

Woudn't it have been better for him to say, "I vaguely remember the guy. Yes. It's coming clear now. He was kind of short. About 5'8 or 5'9. Kind of thick. Black guy. Tough looking black guy. He was wearing a hat with the #5 on it and a Little Rock Christian t-shirt. Something like that. Someone screamed "Fire!" Or was it "Dryer?" I can't remember. I had the perfect sentence for Updyke and he goes and pulls a fast one. Where is his FAMILY on a day such as this? Wouldn't an attorney ask such questions rather than throw caution to the wind and just count on him showing up? And it looks as if dementia or instability are off the table if your going to let the hateful bastard just wander around Lee County.

The Tiger Express station where Harvey Updyke alleges he was attacked.
Hey everyone.
So Harvey Updyke, the alleged tree poisoner, told Opelika police that he was attacked on his way home from the Lee County Courthouse this afternoon. He told them that he pulled into the Tiger Express gas station to make a purchase and was “assaulted by one or more people.â€
Updyke’s lawyer, Glennon Threatt Jr., said on Paul Finebaum’s radio program that his client was hit as he was pumping gas in front of the station.
“Before he could get out of the car, it went black,†Threatt said. “He woke up on the ground next to the gas pump at the gas station. The clerk had called the Opelika police and the Opelika police responded.â€
Updyke says he never saw the assailant(s) who punched him.
Allan Elkins, a captain with the Opelika PD, said officers did observe two scratches on Updyke’s face: A 4-inch cut above his right eye and a 1-inch scratch between the eyes. Still, Elkins said “the extent of his injuries does not equate to an assault charge.â€
Elkins told the Opelika-Auburn News that Updyke “has not really been too cooperative at this point.â€
Here’s where it gets weird: The clerk who was working throughout the afternoon said she saw nothing unusual. Nobody came into the station claiming to have been assaulted. Nobody came in asking for help.
She has an unobstructed view of all the pumps. That side of the station has floor-to-ceiling glass panes that provide a clear view of the storefront. The clerk faces the pumps while working.
“It’s been a regular day except for all the reporters,†said the clerk, who declined to give her name. “He never came in here and said anything to me about it. He never came in the store. The only way I know about it is news folks.â€
Updyke told police that he went from the gas station to East Alabama Medical Center for treatment, which is about two miles away. We know that happened because a reporter from CBS 8 in Montgomery interviewed Updyke there. He then allegedly came back to the gas station to review surveillance video.
The clerk, who was the only employee on site until approximately 5 p.m., said nobody asked her for surveillance video.
If Updyke did park in the front of the station, he would have been in plain view of that clerk and anyone around him.
Could Updyke have parked on the side or behind the station instead? I spent 15 minutes at the gas station beginning at 5:35 p.m. Twenty-seven cars pulled in. All of them parked in front of the building.

So, could this alleged assault have actually occurred? I find it suspicious for a few reasons.
• Updyke likely would benefit from a change of venue in his criminal case.
• Updyke likely would benefit from demonstrating that Lee County is a dangerous place for him.
• The clerk working at the time of the alleged incident said she saw nothing unusual. Nobody entered the store asking for help or to report an assault.
• If Updyke was pumping gas in front of the store, why didn’t the clerk see anything?
• The clerk said nobody requested to see surveillance video, which contradicts what Updyke told Opelika police.
I’m not a judge. I don’t play one on TV. I don’t have every available piece of evidence in front of me.
Still, something here seems fishy to me.

Let’s piece together the events of this afternoon, shall we?
1. Harvey Updyke, a man so shrewd he admitted to (virtually) the entire state on live radio he had committed the crime which now threatens to put him behind bars for years, pulls into this gas station. He claims that as he exits his car, he is immediately assaulted by an unknown assailant. However, the attendant at the station sees nothing occur and tells reporters she believes Updyke to have been behind the station when the assault occurs.
2. The assailant knocks Updyke completely unconscious. In the words of his lawyer, “it went black†and “he woke up on the ground.†However, Updyke does not tell police that he was knocked unconscious, saying that he was “punched about his face†by one or more assailants. Or, per the attendant, he was either knocked unconscious or punched about his face behind the store.
3. Because he has been knocked completely unconscious, Updyke is unable to provide any kind of description of his assailant or any kind of potential identifying detail. Or, in the event he was conscious, Updyke is unable to provide any kind of description of his assailant for reasons that this blogger is unable to discern. The police chief reports that Updyke “has not really been too cooperative.â€
In either case, there are no other witnesses despite this occurring in direct view of the attendant. There is no surveillance video. Fortunately, because he is so shrewd, the accused criminal is a highly credible sole witness.
4. Despite having either been knocked completely unconscious or assaulted so badly he was unable to offer a single detail regarding his attacker or attackers, Updyke’s only injury (or only one worth reporting, anyway) per the Opelika police chief is “a scratch on the forehead.â€
5. Despite having been knocked completely unconscious just minutes before — potentially by a wooden board, though why doctors would need to tell Updyke how he had been attacked when he told police he had been punched is curious — or simply assaulted by an attacker or attackers who must not have gotten too far either on foot or in the car Updyke managed not to see while he engaged in some activity this blogger is unable to discern, Updyke declines to call either an ambulance or police. He drives himself to the East Alabama Medical Center.
6. Despite having been knocked completely unconscious, potentially by a wooden board, Updyke is released by the EAMC within the neighborhood of 60-75 minutes.
By everyone’s account, this is an extremely small amount of time to wait in an emergency room with any kind of serious injury, such as the kind sustained when being knocked completely unconscious, potentially by a wooden board. Though to be fair, Updyke himself did not believe himself to have been either knocked unconscious or struck by a wooden board.
6.While there, Updyke meets with a television reporter. Within minutes, the lawyer is appearing on the Schmaul Schmineschmaum Schmow (er, Show) to explain about the attack. “I had nothing to do with my client being attacked at a gas station,†the lawyer says, for unclear reasons.
So, what conclusions can we draw about the events listed above?
If you believe many mainstream journalists like Pat Forde, there is only one: football fans in Alabama are barbarians, Auburn fans like the one that assaulted Updyke included. The events of the afternoon make it obvious.
To which I can only say, well, clearly.

1) So you have a cut above your right eye but yet you did not see anything. No other contusions just this cut above your eye. Well if this is true then one must assume that the turd was hit with the yellawood above the eye. And he saw nothing? I understand that i have been a bit hypersensitive to my surroundings after being in the corps but even the most lackadaisical person in the world will realize/remember when they are about to be assaulted from the front. Especially someone trained in law enforcement.
2) So you are a good Samaritan concerned about what you just saw happen. This poor man has been assaulted and is blacked out on the ground. You grab you cell phone, and dial not 911 but the CBS affiliate in Montgomery? I know when I have seen other people in trouble my first instinct is to call a television station.

Paul is skeptical. I listened the last 25 minutes of the show, and he was definitely starting to admit it was fishy.
Though he was more critical of the Montgomery news people than Updyke or his lawyer.

No shit. Lets see, some Auburn fan that was crazed enough to do this just so happened to be at the same gas station at the same time with a stick of wood to swing across Updikes head. No one saw it, no video evidence, and he (Updike) was knocked out so cold that he saw nothing but was able to drive himself to the ER. Not to mention all the ER did was wipe him up and send him on his way; or was it he got tired of sitting there and he just left. Which is it? Wow, any moron to believe this shit needs to be slapped with the back hand.

This is a pretty ham handed attempt at a set up, or he was actually assaulted. But, like bammers, I'm going to convert what I believe in my heart in to cold hard facts. He faked this shit! Did Threat put him up to it? Maybe, but I'd think it would have come off better if he had. I think Harvey is so pathetically stupid, that he did this. Did he have help? Who the fuck knows? I'm even betting that he had planned to actually stab himself superficially, but chickened out. Harvey may have even made the call himself BEFORE he did what he did.

Wednesday's reported attack on Harvey Updyke, if verified, could actually be a good thing for the Alabama fan who is accused of poisoning the iconic oak trees of Toomer's Corner in Auburn.
Updyke has already been tried and convicted in the court of public opinion. He is the butt of jokes and his alleged actions underline the word stupid in stupid criminal.
But Updyke is due his day in court. And that process began Tuesday with a preliminary hearing. Soon afterward, Updyke was allegedly attacked at an Opelika gas station parking lot. And the injuries he claims to have sustained were serious enough that he was examined in an emergency room.
If the reported attack is substantiated, it is helpful to Updyke as he tries to rebuild his image as that of a sympathetic figure. Previously, Updyke's attorney, Glennon Threatt, was busily trying to portray his client as a feeble older gentleman who has health problems.
For a man who spent weeks as public enemy No. 1 in Alabama, nothing would do more for his image than to shift the focus from reviled clown to sympathetic figure who was attacked for his sins.
This could turn out to help in finding a jury that would rule in his favor if his case goes to trial.
So basically, this lawyer, who has previously been trying to paint Auburn as an unsafe place for his client in attempt to change a venue, also has been trying to gain sympathy for Harvey by "portraying his client as a feeble older gentleman who has health problems."
So no one sees the motive in him getting him to do this?
Also, the eye witness at the gas station is somehow less credible than the second hand witness, that being his lawyer and the CBS chick, who didn't see the attack?

So basically, this lawyer, who has previously been trying to paint Auburn as an unsafe place for his client in attempt to change a venue, also has been trying to gain sympathy for Harvey by "portraying his client as a feeble older gentleman who has health problems."
So no one sees the motive in him getting him to do this?
Also, the eye witness at the gas station is somehow less credible than the second hand witness, that being his lawyer and the CBS chick, who didn't see the attack?
