i just really don't see the NCAA sanctioning Alabama for something it knew NOTHING about. what decides that is not so much when whatever impropriety took place, its more so when the university found out and what it did about it. how is the NCAA going to punish Alabama for something that was not done by the university or somebody acting on its behalf or in its interest, but was done on the sly by Andre and a family member? that makes absolutely no sense. i doubt this thing even went past the SECCG anyway, if not between now and then. where USC got their asses in a crack was that they were letting the agents from New Era into the locker room to do business with Bush, letting them watch games on the sidelines, etc etc. they knew what was up and didn't do shit. while Andre stayed out of trouble while at Alabama, he really screwed the pooch with this. he knew what was up and if in fact the university did request his phone records and he refused, it screams that he did.
EDIT: CNS just spoke regarding Andre and he says that Alabama has verified with the NCAA that this will be an institutional matter to resolve and not an NCAA matter, otherwise meaning there will be no NCAA fallout from it. he also says that Smith could come back next season if he wishes according to the NCAA. so, if the NCAA sees no reason to get involved in it, then i wonder what the fuck actually happened.

The NCAA doesn't work that fast, I'm not saying that it won't be an institutional matter...eventually, but the uat officials found out about what had happened, had a meeting with Andre and I'm guessing $aban, they felt that it was best for the University to Not let Andre play in the Sugar Bowl, supposedly after Andre wouldn't let the University have his cellphone records...this happened on Saturday or Sunday...Yesterday (Tuesday) it was stated that the AG dept. and Troy King is stepping in to "Investigate" the matter. So, the NCAA, I'm guess with the help of Gene Marsh, has decided to state...."Nothing to see here, everything is hunky dory." It's funny that McClain stated, in the B'Ham News today, something about this being handled as a "family matter"...is he saying that it'll be handled "In House", and if so, how would he know that in the matter of two days?
The agent...or now, agents will probably be taken to court, because in the State of Alabama, the maximum sentence for illegal contact made by an agent to a Student-Athlete and/or family member(s) is up to 20 Years. Also, the Cell Phone records might be incriminating. We should know more by Monday or Tuesday...that is if you can wade through all the bammer homerism.
IMO, with uat Not being USC or the Bell Cow of a conference, if Andre made contact with the agent or agents before the season started or sometime during the season, he would be considered ineligible and uat would have to forfeit ALL games he played in. I'm not sure forfeiture would occur if it was just someone close to Andre that made the contact, unless Andre knew about it....basically okaying it...which would be the same as him making the contact with the agent or agents. If uat knew about it, depending on when it happened, and let it go, that would bring the LOIC tag to be placed on the uat program with the addition of Repeat Offender. uat would be looking down the "Loaded Barrel" with a Bullseye between their eyes.
No one Really knows what happened except for a handful of bammers......but, everyone should know what'll happen.
