Former University employee sues under Whistleblower Act

A former employee of the Athletics department’s fundraising wing, Tigers Unlimited, is suing Auburn University.

W. Matthew Davis is listed as the plaintiff in a lawsuit filed Thursday, Oct. 15, in federal court.

Davis’s suit alleges the University fired him after he conducted an audit of tickets designated as part of the Tigers Unlimited program and found between 3,500 and 3,800 tickets that were meant to sold through the Tigers Unlimited program were instead being sold at face value.

Davis told David Benedict, associate Athletics director, about the discrepancy and after Benedict met with Jay Jacobs, Athletics director, Davis was told to “’keep his head down and mouth shut’ and forget about those tickets,” according to Davis’s suit.

After Davis discovered the ticket discrepancy, Davis alleges, he was put under investigation by the Athletics department.

Davis was terminated for communicating with a consultant named Mark Tilson, whose contract had been canceled unbeknownst to Davis, according to his complaint.

Davis is suing The University for violating his first amendment rights and under the Alabama Whistleblower Act.

I know very little about this saga and haven't cared enough to research much. But I do know a few people who were pissed about their allotment for Az in 2010 and if 3500 were sold to a handful at face value, somebody got some splain'in to do. Or, at least they should.

I'm skeptical of these whistleblower cases. And this one is no different. But, if there was impropriety, maybe good will come out of it.

I assume and hope that it won't affect AU directly and only the alleged responsible wrongdoers, which means we'll probably get the death penalty.

Something tells me this involves Jacobs.

Jacobs can make this up in a fundraising weekend. He'll just reappropriate enough money to cover it.

I posted a Montgomery advertiser link a couple of weeks ago about this in the "what is our issue?" (Or similar) thread. This really smells bad. And yes maybe it will mean the end of that schmuck.

Would it be a bad idea though if this was a situation that rid AU of Jacobs? I mean, right now this seems like the only way to do so without a mass overhaul that included football.
