You know it’s been a big year when even your team’s NCAA compliance directors become alumni club circuit rock stars. So yeah, here’s our reporter’s notebook (as scribbled by the weighed down fingers of Terry Lathan, a Mobile Auburn Club advisory board member) from Rich McGlynn’s Monday night speaking engagement with the Mobile Auburn Club at True’s Midtown Restaurant.

Stories told: A younger player gave his three rings to his mother and father because he planned to win more. Nick Fairley smiling at McGlynn on the sidelines down 24 points at Bryant-Denny and saying “I got this.” Normally calm Cam getting rather vocal about winning the game during halftime. Gene Chizik’s pre-BCSNC game insistence to the team that this was a great moment in their lives, but not greater than getting married, becoming a father, raising a family, or playing with your grandchildren.

The Juicy Stuff: McGlynn said the compliance department had to take a conservative win the war, not the battle approach. They knew they were right, but couldn’t talk about it. Had he thought Newton was anything less than eligible? There would have been no Newton. Outcome was exactly what they thought it would be.

Before the event, McGlynn spoke to the Mobile Press-Register regarding the status of Florida running back transfer Mike Blakely.

“We have filed a waiver in an attempt to see if we can have Mike be immediately eligible and we’re in that process right now,” said McGlynn, who spent five years on the NCAA staff before accepting his Auburn position. “We’re working with the NCAA and hoping to get a favorable outcome on it. That’s where we are at this time.”

Blakely would give the Tigers some much need depth at running back where they have only two experienced players in sophomore Mike Dyer and junior Onterio McCalebb.

McGlynn said he hasn’t seen an appeal be impacted by the fact that a player never practiced at his previous school. “But that doesn’t mean anything,” he said. “The NCAA takes each case on its merits and looks and reviews those specific facts and makes a decision.

“We need to make an argument based upon the rule. The rule was not put into place based upon an individual in Mike’s situation in order to be eligible here at Auburn. I believe we put together a strong waiver to that. Now it’s just a matter of seeing what the NCAA has to say about it.”

McGlynn said he expects to have a response from the NCAA within three weeks.

Rich McGlynn, during an interview with Phillip Marshall released today in AuburnUndercover.com, discusses the process the University followed during the media frenzy surrounding Cam Newton's questioned eligibility. While some have started to use this article as a basis for declaring the Newton controversy for all intents and purposes "over," there still remain several voids in information provided which, at least in my mind, require at a minimum an answer from University Officials before reconciliation can truly be achieved.

During the interview, McGlynn clearly confirms the NCAA agreed with what was presented BY THE UNIVERSITY as the factual course of events outlined during Cam's reinstatement. What McGlynn does NOT disclose is how could they possibly do otherwise? The presentation made on behalf of Newton for reinstatement was based SOLELY on the information provided "AT THE TIME" by Auburn University. There is no investigative body that reviews the information provided. They merely assess if the information provided by the University allows for such a reinstatement. What was NOT stated by McGlynn nor Marshall is the fact over 98% of reinstatement applications being made are accepted. The University simply devises a way, given a course of events uncovered by the media, for there to be a plausible explanation as to who, what, where, when, and why occurred -hence the disclosure admitted by CECIL and the immediate LOCK DOWN by the Sr. Newton from any and all media contact aided by "friends of the program." Need proof of this? The "Agreement" publicized forbidding Newton attending the BCS Championship game announced by Jacobs. Still waiting for the documentation on that one.



McGlynn states:

“I knew we had a pretty good argument that Cam had very little culpability. In fact, none. I think we put a really strong argument together that, although technically this bylaw might have been violated, it does not warrant withholding an individual from competition, especially when he had no knowledge it was going on. That, I think, is ultimately what the NCAA agreed with."
For the sake of this argument, let's assume McGlynn's assertion to be representative and CAM DID IN FACT NOT KNOW what his father was up to bidding his services (I personally have a very hard time believing it given Cam's public disclosure for his love of BOTH Mullens, but let's roll with AU's proclamation for the moment). Based on that assumption, it is now common knowledge confirmed by Auburn's Compliance officer that Cecil did in fact initiate a Pay 4 Play scheme involving Mississippi State. Based on the conversations revealed during the turn of events, and Phrases such as "Rented Mule" and "Not gonna be free this time", not to mention Cam's love for his former coach, just how is it that Cam ended up at Auburn?

McGlynn Continues:

“I completely understand when you step back and say, ‘Someone soliciting $180,000 from somewhere, there is no place for that in college athletics.’ But the rule isn’t written to cover that situation. There were times we went back and forth and had a very open dialogue about the whole process. If I'd had a concern about eligibility, he wouldn’t have played."

Why is it that nobody in the Media has asked the what seems logical next question? If State was paying 180K, how is it that AU was able to acquire the "rented mule" free of charge given Cam's openly stated desire to play for the Bulldogs?

The Culpability issue, given the format and procedures the NCAA had in place at the time allow for the University to twist the presentation in such a manner as to secure an athlete's eligibility, at least on an interim basis (See OHIO STATE and the reinstatement of the Tattoo 5). When you combine the fact Cecil was demanding $180K from State, yet Cam signed out of nowhere to play at AU, SEVERAL holes in Auburn's presentation to reinstatement still remain. Although not directly from the mouth of the NCAA because they will not acknowledge or discuss any ongoing investigation, is my understanding this question as to "Why Auburn, given the facts as presented" as well as other inconsistencies or voids in a natural flow and progression in deciding which University to attend are the basis of why Cam was, and remains under investigation by the NCAA. IF you feel otherwise, ask yourself why investigators were in Montgomery Monday and Tuesday asking questions regarding Newton and the University? If that question is not enough to raise an eyebrow, follow up with an attempt to understand the magnitude of Legal Fees paid Lightfoot, Franklin, Auburn's counsel regarding matters involving the NCAA. Again, nothing to date has been released indicating guilt or innocence on the part of Newton and Auburn regarding the investigation, but the revelation of these facts at a minimum indicate there is smoke billowing from the AD's office of Compliance.
