That would have been even better, but who knows, its still possible.

My guess is the lawyer will paint Updyke as a sad, delusioned social misfit who once was a faithful public servant that fell on hard times and has struggled for many years with a lack of purpose and depression.

It's just that these things never go down the way we want them to. And he might be just what I described. Doesn't hide the malicious, pre-meditated act but the judge has to feel cornered by some degree especially if this is the guy's first run-in at his age. But Updyke was proud of himself so he might also show some of that classiness we keep hearing about.
