Two people have been arrested after a county-wide marijuana sweep in Lawrence County. Sheriff Gene Mitchell said agents seized marijuana plants and shut down an indoor grow operation.

Mitchell said agents arrested Billy George Hampton, 58, and Kathy Denise Hampton, 62, of Danville, on one count of first-degree possession of marijuana and one count of possession of drug paraphernalia.

Mitchell said that the Hamptons were arrested after an ALEA helicopter flew over the residence and found several large marijuana plants growing at the rear of the home. While the helicopter pilot was hovering over the Hampton residence, Mitchell said Billy left the home and started harvesting the marijuana plants and placed them in a wooded area in an attempt to hide them from the pilot's view.

Investigators said when ground units arrived at the Hamptons' home, agents detained the couple. He said during a search of the home, agents found 15 large plants, several hundred marijuana seeds, and several items used to grow marijuana with from the beginning stages to the adult stages.

Mitchell said agents also found a bedroom that had been converted into an indoor grow operation. Agents believe the couple used the indoor grow operation for the early stages of the grow to start the plants and then transferred the plants to bigger containers to be able to use sunlight. Mitchell said agents also found two sets of digital scales they believe were used to weigh marijuana for a distribution operation.

Investigators said the Hamptons were booked into the county jail on a $2,500 bond and later released.

The sweep was conducted by the Lawrence County Drug Task Force and agents with the Alabama Law Enforcement Agency (ALEA).

Narcotics agents in Tuscaloosa arrested a 22-year-old University of Alabama student accused of possessing massive amounts of the prescription anti-anxiety pill Xanax.
Sgt. Brent Blankley said agents with the West Alabama Narcotics Task Force conducted a month-long investigation that eventually led to the doorstep of the alleged dealer, Ryan Patrick Jones.

Jones was arrested at a home on Meador Drive, very near to the University of Alabama campus, where agents found more than 10,000 Xanax pills and 141 grams of marijuana.

Blankley said officers estimate the street value of the drugs is more than $75,000.
Jones was charged with possession of a controlled substance, first-degree possession of marijuana and selling drugs near a school.

He was placed in the Tuscaloosa County Jail, where his bond was set at $35,000.

LEXINGTON, AL (WAFF) -
A Lauderdale County man is in intensive care at ECM Hospital after police say he was lured to a home and attacked by two men.

Police say the assault happened Friday night at a home on Goardsville Road in Lexington. Police chief Augie Hendershot says the victim was lured to the home by Tiffany Speegle, 19.

When the victim got to the home, police say he was attacked by two men with an ax handle, robbed and his hands tied with electrical tape. After the trio left, the victim made his way outside, and a neighbor found him and called 911.

Police arrested Allen Holt, 19, and charged him with assault and robbery. His bond was set at $100,000. Speegle was also arrested and charged with robbery. Her bond is set at $50,000.

Police are looking for the second male, Jonathan Thompson, 19. If you see Thompson or know where he may be, call the Lexington Police Department at 256-229-5564. a

A youth cheerleading coach in Boaz has resigned - and made news across the U.S. - after a parent complained about a KKK-themed shirt he wore to a practice.

Brian McCracken, who served as assistant vice president of the squad, resigned, as did his wife Melynnda, who served as the vice president. The story, originally reported by WAFF-TV in Huntsville, has made its way across social media and onto the news across the country.

McCracken stirred up controversy when he showed up at the squad's practice wearing a T-shirt emblazoned with a white-robed, hooded KKK member. A burning cross is seen in the background and the shirt proclaims the KKK the "Original Boys in the Hood."

Boyz N The Hood is a highly-acclaimed 1991 movie depicting the struggles of life for African Americans in south central Los Angeles.

McCracken's friend, Brian McDowell, wore a shirt that said "White Pride" at that same practice. The men reportedly said they wore the shirts as a joke.

CBS 6 out of Richmond, Virginia, reports that Kayleigh Tipton, the parent and volunteer coach who complained to league commissioner Kenny Jones, was asked by Melynnda McCracken not to come back as a coach after she made the complaint.

Jones said the league has cracked down on parents, informing them that racially-insensitive shirts like those worn by McCracken and McDowell are not tolerated.

Hail to the Houndstooth: The Distinctive Charitable Fundraising Arm of the University of Alabama

For fans of the University of Alabama Crimson Tide, a college football team that has had an extraordinary ability to do exceptionally well year after year in NCAA football, the importance of the houndstooth pattern is immediately understandable. Legendary coach Paul “Bear” Bryant wore a black and white houndstooth hat to most games beginning the year after the New York Jets drafted Alabama quarterback “Broadway” Joe Namath (Bryant got the hat originally from Jets owner Sonny Werblin).

Although Bryant died in 1983, houndstooth may be the bond that unites many of the power players at the University of Alabama and its private foundation fundraising arm, the Crimson Tide Foundation. Birmingham News columnist John Archibald writes that there are lots of connections among people on the University of Alabama board of trustees and the Crimson Tide Foundation to the Bryant Bank that was founded by Bear Bryant’s son, Paul Bryant, Jr. For NPQ, given its nonprofit emphasis, even more interesting are Archibald’s insights into questions that might be asked about the Crimson Tide Foundation itself.

Bryant Jr. was the president pro tempore for the UA board of trustees, but has been replaced by Karen Brooks, a Bryant Bank board of directors member. Also on the ’Bama board are John Mark Bentley, a vice president at Bryant Bank and son of Governor Robert Bentley; emeritus trustee Angus Cooper II, whose son, Angus Cooper III, is a vice president at Bryant Bank; and Barbara Humphrey, who is married to Bobby Humphrey, another vice president of Bryant Bank. Also connected to Bryant Bank are UA Senior Athletics Director Finus Gaston, and UA Associate Director of Planned Giving William “Butch” Hughes, both members of the Bank’s board of directors.

Particularly interesting in this article, however, are Archibald’s comments about the Crimson Tide Foundation, which is described on the Roll Tide website as a 501(c)(3) “charitable arm of the University of Alabama Department of Athletics.” Archibald reports that Paul Bryant, Jr. is the chairman of the Crimson Tide Foundation, Angus Cooper II was on the board (though a bio of Cooper at the Iberia Bank site indicates that he is the VP of the Foundation board; whatever his status, he is a donor of more than $1 million to the foundation), and William Britt Sexton is on the board (and through the Sexton Family Foundation a donor of between $100,000 and $500,000).

Archibald’s note that the Foundation has “stopped reporting to the IRS in public documents” is an attention-grabber. Unfamiliar as we are with public charities that can simply not submit 990s, we checked on GuideStar and discovered that the last publicly available 990 identified with the Crimson Tide Foundation was for Fiscal Year 2005 (ending June 30, 2005), in which the charity took in revenues of $33.9 million. The Foundation still seems to be quite active, Form 990 or no. We found a recent University of Alabama document that contained brief financials on the Crimson Tide Foundation indicating that it had total revenues in Fiscal Year 2014 (ending June 30, 2014) of $62.6 million, up 22.2 percent over the previous year, and ending with total assets of $155.7 million.

Archibald says that the UA board of trustees “doesn’t act like a public institution…[but] like a family business, interrelated and dependent, compromised and compromising. It is a family business that, too often, considers its business none of your business…The board for decades has operated in the smoke and shadows, thumbing its nose at public records and open meetings laws, discouraging conversation among board members in the light of day.”

If that is the case for the University board, it probably applies double to the Crimson Tide Foundation board. The two websites that seem to be Crimson Tide Foundation websites, the Roll Tide site associated with the UA Athletic Department and the foundation’s own site, don’t seem to have lists of the foundation’s board members. Rather, we found the 2013-2014 board list for the foundation on p. 80 of the annual report of the Athletic Department. Somehow, without 990s to show and without even the barest semblance of official transparency that characterizes other public charities that file 990s with the IRS, the Crimson Tide Foundation receives contributions not just from individuals, but from intermediaries such as the Network for Good and from foundations such as the Daniel Foundation of Alabama, the William David Gwin Sr. Family Foundation Trust, the Russell Family Foundation, and the Ray Foundation.

According to Archibald, the foundation contends that it doesn’t have to submit 990s because “it is affiliated with a government entity: the UA Board of Trustees,” though that explanation seems to run contrary to the fact that regardless of the relationship with the UA, the foundation is a legally incorporated 501(c)(3). The IRS would presumably want to look at the foundation’s 990s, which would include things like its purchase of a home at the price of $3.1 million for football coach Nick Saban. Actually, the foundation purchased the 8,759 sq. ft. home from the Sabans, which they had purchased for $2.9 million in 2007, but the Sabans still live there, mortgage-free and tax-free, as the foundation paid the $10,000 property tax bill due on the home at the end of 2013 but has since had the home treated as tax-free by the Tuscaloosa Tax Assessor because of the foundation’s nonprofit tax status. Saban’s current annual salary of $6.9 million, prior to performance bonuses, does not include the cost of the home.

Perhaps the foundation was unhappy with the fact that with its filing of a 990 in 2005, it had to reveal that it had purchased an Israeli-manufactured nine-seat airplane which is used by Saban and other personnel for recruiting purposes, including transporting potential Crimson Tide football players to Tuscaloosa. Maybe the IRS might have had questions about why the foundation bought the Westwind Astra to replace an older, smaller Cessna that the university itself owned, and about the charitable nature of the $477,000 annual cost of operating and maintaining the plane (as reported in 2005 by Alabama Aviator in 2005) and the $2,700/hour flight cost according to Gulfstream, the manufacturer that bought the Israeli manufacturer in 2001. Writer Michael Casagrande in 2014 noted that “the plane’s movements cannot be accessed otherwise because the school had the tail number blocked from flight-tracking websites,” probably because of the competitive nature of ’Bama coaches’ and recruits’ dynamics vis-à-vis other football teams, but like the lack of 990s filed for the foundation, the university’s ability to camouflage the movements of its airplane seems unusual, to be sure.

Presumably, Alabama boosters are quite happy with the team’s consistent winning record, attributable to the kind of expenditures that the Crimson Tide Foundation is able to accommodate. But boosters and the public at large should see those kinds expenses in official reports that, for a 501(c)(3) public charity, ought to be reviewed by the IRS. It isn’t exactly clear to us from the IRS instructions on 501(c)(3) entities required to submit 990s exactly how the Crimson Tide Foundation might be exempted from filing. Assume for the moment that because of the foundation’s relationship to the university, it does have an option not to file. But does it have to take advantage of that option? Using a quick search on the Foundation Center’s 990Finder, we found scores of foundations related to public universities that had filed their fiscal year 2013 990s, including foundations affiliated with Michigan State University, California State University (separate ones for the Bakersfield and Stanislaus campuses), the University of North Carolina (multiple foundations for different campuses), Florida State University, Idaho State University, Minnesota State University at Mankato, Minot State University in North Dakota, the University of Georgia, the University of Iowa, and even the University of Texas—which, it should be noted, was trying to recruit Saban away from Alabama when the Crimson Tide Foundation concocted the plan to purchase Saban’s Tuscaloosa home.

Somehow, all of these university-affiliated foundations and dozens more were able to file 990s notwithstanding their fundraising activities to benefit a public university. But the Crimson Tide Foundation doesn’t provide the typical 501(c)(3) disclosures that we, and presumably the IRS as well, would expect of just about any public charity or private foundation. If a private foundation linked to the University of Alabama is able to avoid filing a Form 990 with the basic elements of transparency that nonprofits provide as a matter of course, it does not bode well for the public’s right to know in light of the increasingly popular practice of public agencies establishing 501(c)(3) foundation arms.

Ole Miss Student Allegedly Punched By Angry Bama Fan After Saturday’s Game

Ryan Moore, 22, an Ole Miss undergraduate student was allegedly punched in the face by an angry Alabama fan after the game. 
 
Ryan Moore, a 22-year-old Ole Miss student from Tupelo, was walking with friends in downtown Tuscaloosa when he was allegedly sucker punched by an angry Alabama fan after the Ole Miss vs. Alabama football game at Bryant–Denny Stadium Saturday night.

The punch broke his jaw in two places, and Moore has been in and out of surgery since Saturday night.

Mike Moore, Ryan’s father, said that their number one priority is getting him back into good health. Once he is in better condition, they plan on filing a complaint with the University Police Department. The next step would be for UPD to send the complaint to the Tuscaloosa Police Department.

Curtis Owen, a family friend, said, “Ryan is one of the nicest young men you will ever meet, and very respectful. He’s not the rub it in your face kind of guy.”

According to Moore, Ryan was walking to his car with a group of friends in downtown Tuscaloosa 30 minutes after the game. They were celebrating the win shouting “Hotty Toddy” and (allegedly) an irate Alabama fan blindsided Ryan (who didn’t see the punch coming) between Salon 5 and Pizza Hut.

The Alabama fan is described as a white male with salt and pepper hair, weighing about 220 pounds, with an athletic build. He was wearing a dark-colored Alabama shirt and jeans and was walking with a woman and two little girls.

After Moore was punched, the Alabama fan disappeared.

“Ryan was set to graduate this December. He was really excited to finish from Ole Miss and get his degree. Now with all the surgery and recovery process, we aren’t sure he will be able to finish by then,” Moore said.

Anyone who knows anything about the incident is requested to come forward with information to Mike Moore at 662-322-1822. Currently Moore and Owen are hoping the businesses caught the incident on video and will cooperate in helping to find the man who punched Ryan.

“I don’t care what team you cheer for, this is unacceptable,” Owen said.

Five University of Alabama fraternity members were arrested in Tuscaloosa today on charges of hazing.

The students are members of Phi Gamma Delta. All five were booked into the Tuscaloosa County Jail with bond set at $1,000.

The fraternity members several weeks ago reportedly made pledges stand in buckets of ice and salt, a combination which led to burns on the pledge's feet. University officials didn't confirm those specifics, or the time of arrests. AL.com asked school authorities midday about the hazing allegations, and they said they weren't aware of any. They then released a media statement about 6:30 p.m.

School spokesman Chris Bryant said the arrests followed a thorough joint investigation by the University of Alabama Police Department and the UA Office of Student Conduct.

Those charged are: Colter K. Anderson, 21, Dallas, Tx.; John Patrick Buckley, 21, Houston, Tx.; Hunter Lee Wagner, 20, Huntsville; Richard E. Markwalter, 20, Huntsville; and Mark Allen Powers, 20, Athens. Powers faces one hazing charge; the other four are charged with three counts each, Bryant said.

Hazing is a Class C misdemeanor. In addition to the arrests, Bryant said the students have also been placed on interim sanctions by UA and are being referred to UA's Office of Student Conduct. School officials didn't specify the interim sanctions.

"The University of Alabama will not tolerate hazing and takes allegations and incidents of hazing very seriously,'' Dean of Students Tim Hebson said in a prepared statement. "Students who are the victims of, or who become aware of, hazing incidents are strongly encouraged to bring these incidents to our attention."

UA, together with Phi Gamma Delta International Fraternity, has placed interim sanctions on the chapter. The sanctions include no social events and no new member activities, Bryant said.

School officials ask that any students aware of hazing incidents call the hazing and harassment hotline at 205-348-HALT (4258) or UAPD at 205-348-5454. Both numbers are open 24 hours a day, seven days a week. Calls to the hotline are confidential and will be referred to the Office of Student Conduct and UAPD. Authorities said callers should provide specific information including names of organizations, times and locations.

A woman is in a Tuscaloosa hospital and four men are behind bars after a reported gang rape.

Three of the suspects are students at the University of Alabama, police said this afternoon. The victim is a student as Shelton State Community College.

Tuscaloosa County Metro Homicide Unit investigators were called to a home in the 5500 block of Old Montgomery Highway about 10 a.m. Tuesday on a possible sexual assault. When they arrived, the learned the unresponsive 22-year-old victim had been taken DCH Regional Medical Center, said Capt. Gary Hood.

Witnesses told lawmen they found the young woman unresponsive in an apartment. They said she was knowingly drinking a beverage which had a controlled substance in it with some friends at the apartment the night before. Hood this afternoon said the drink was a combination of fruit punch and Xanax.

Those witnesses told investigators the victim passed out in the bedroom of 20-year-old Donald King. They reported that King and three others had sex with the victim while she was unconscious. Hood said three of the suspects were in the room with the victim all at the same time.

"She woke up at the hospital and doesn't recall anything,'' Hood said.

Hood said all of the suspects admitted to having sex with the victim, and one of them admitted that she was unconscious when it happened.

The victim was admitted to the hospital overnight for monitoring, but her injuries aren't believed to be life-threatening. Hood said she had physical injuries from the sexual assault.

Those charged with first-degree rape are: King; Eddie Harris Jr., 19; Fredrick Shaw, 18 and DeAndre Dussett, 25. Hood said Dussett may face additional charges by the West Alabama Narcotics Task Force. King, Harris and Shaw are UA students.

"If you don't drink alcohol, you reduce your chances of becoming a (sexual assault) victim by 99.9 percent,'' Hood said.

A former Alabama running back found more trouble at his third collegiate home.

Altee Tenpenny was arrested Sunday in Louisiana for possession of a firearm and discharging a weapon, houmatoday.com reports. Nicholls State released a statement to the newspaper saying Tenpenny was suspended.

The school is Tenpenny's third in less than a year. He was dismissed from UNLV's team in August after transferring from Alabama in January. He landed at Nicholls State later in August.

Dustin Kent, uncle of Brittany Wood, was sentenced to 17 years in prison in a Baldwin County courtroom on Thursday.

Kent pled guilty to the sex abuse and sodomy charges against him.

He's also awaiting a November sentencing in Mobile County for sex-abuse charges.

According to Mobile County jail records, Kent has been charged with rape eight times, sodomy five times in addition to producing porn with juveniles.

Brittany Wood, then 19, was last seen in 2012 and was molested by several family members.

Agents with the Morgan County Drug Task Force and Morgan County Deputies arrested eight people on drug charges over the past week.
On October 16, agents attempted to locate and arrest Bobby William Whitaker Jr. on heroin charges. Agents found Whitaker at his home in Lacey Springs, where a woman had overdosed on heroin.  Whitaker fled from the scene when the agents arrived.
While at the home agents arrested Jessica Nichole Whitaker, 23, and Terry Davis, 41, for the unlawful possession of a controlled substance.
Two days later deputies acted on a tip of Whitaker being at a home on Lower Dry Creek Road. When the deputy approached Whitaker he fled into a wooded area. Agents were called to the home where "ICE" methamphetamine was found.
Agents arrested Daniel Price, 28, and Sarah Cross, 36, for unlawful possession of a controlled substance.
On October 22, deputies once again received information on Whitaker's whereabouts. Officers went to a home on Lower Dry Creek Road  where they found Kevin Daniel Payne, 23, Bobby Whitaker Jr., 38, and Jessica Nicole Whitaker, 23. At the home agents found "ICE" methamphetamine as well as cocaine hidden in a bedroom where Bobby and Jessica Whitaker were found.
Payne was arrested for unlawful possession of a controlled substance. Bobby and Jessica Whitaker were both arrested on two counts of unlawful possession of a controlled substance.
Both Bobby and Jessica Whitaker are pending to be revoked on other drug related offenses.
Also on October 22, agents with the Drug Task Force began executing distribution warrants. Agents arrested Tammy Jones, 51, and Tommy Carver, 51, for unlawful distribution of prescription medication. Bond for both totals $15,000.
Agents of the Morgan County Drug Task Force will be continuing to execute more distribution warrants within the upcoming weeks.

A teacher at Chestnut Grove Elementary School with Decatur City Schools apologized on Monday morning for using blackface as part of his Halloween costume.

The Decatur City Board of Education held a meeting Monday morning to discuss the fifth grade teacher, Heath Morrow, who wore blackface to dress up as Kanye West for Halloween.

The picture gained international attention when the Daily Mail reported Morrow dressed as Kanye West and his wife joined him as Kim Kardashian West in an early Halloween celebration effort.

Decatur City Schools Superintendent Dr. Ed Nichols read a letter from Morrow where he apologized from his error in judgment and said his intentions were not malicious. In the letter, he said he wasn't raised that way and he has not taught his kids that way.

Morrow said he and his wife made a decision based on celebrity and political climates and he doesn't want that to reflect on Chestnut Grove Elementary.

To whom this may concern:

I would like to first apologize for my error in judgment. My intentions were not malicious or directed toward any certain group of people. I would also like to say that everyone who knows my character and knows my heart, knows that I have never seen color in my life. I wasn’t raised or taught that way and do not raise my children that way. I see people for who they are, and my wife and I go out of our way to help anyone we can in my profession as an educator. When deciding to dress up for a Halloween party, my wife and I made a decision based on celebrities and the political climate today. I do not want this to reflect on my school or school system based on my poor decision that I made. Again I apologize and this will not happen again.

Before the letter was read, Nichols said the school system was sad by the actions that took away from the focus of the schools. He said they are looking into the issues and they don't condone the action.

Nichols is planning a meeting with community leaders in an attempt to be more sensitive.
