If a person is in a specific position of power, ie a teacher, jailer, etc..then it's not age that governs...it's consent...and in certain instances, the "victim" is deemed incapable of giving consent because of the actor's position of authority over them.

I sat in a statutory rape jury here in GA a few years back. The kicker was not if the 23 yr old slept with the 16 yr old. It was did he do so 3 weeks before she turned 16, or a day after. Happy birthday.

Unless wherever the "dirty Sanchez" took place, they have a law like Alabama's, where the older party must be within 2 years of the 16 year old's age.
